“Reaction Betrayed Guilt, Panic to Hide Mountain of Illegal Wealth”: Gogoi Targets Sarma

Congress leader cites apex court remarks; SC grants anticipatory bail to Pawan Khera, flags “politically motivated” angle

Guwahati: The political temperature rose on May 1 after Congress leader Gaurav Gogoi reacted sharply to the Supreme Court’s observations in the Pawan Khera case, directing criticism at Assam Chief Minister Himanta Biswa Sarma.

In a strongly worded statement, Gogoi said, “The Supreme Court has criticised the conduct and remarks of Himanta Biswa Sarma… his reaction betrayed panic to hide his mountain of illegal wealth and properties.” He further added that it was “unfortunate” that the people of Assam had endured “corruption and intimidation” over the past five years.

His remarks came soon after the Supreme Court granted anticipatory bail to Khera in a case linked to allegations against Riniki Bhuyan Sarma. A bench of Justices J.K. Maheshwari and Atul S. Chandurkar observed that the Gauhati High Court’s reasoning appeared “erroneous” and not based on proper evaluation of the material on record.

Moreover, the apex court noted that the allegations and counter-allegations seemed “prima facie politically motivated,” suggesting the dispute stemmed from political rivalry rather than grounds for custodial interrogation. It also held that the High Court had incorrectly shifted the burden onto the accused and made unnecessary references to provisions not invoked in the FIR.

While granting relief, the court directed Khera to cooperate with the investigation, avoid influencing witnesses, and seek permission before travelling abroad. However, it clarified that these observations are limited to the bail stage and will not affect the trial.
