Zubeen Garg Case: Shyamkanu Mahanta Denied Bail in Court, Flags Flight Risk

Prosecution cites post-incident conduct, financial links, and negligence; next hearing fixed for May 2

Guwahati: The special fast-track court in Guwahati on April 30 rejected the bail plea of accused Shyamkanu Mahanta, citing serious concerns over his conduct and potential to evade investigation.

Senior Advocate and Special Public Prosecutor Ziaul Kamar stated that “The Honourable Court has passed the bail order… the written order is awaited,” he said. He added that the court observed the accused “attempted to move from Singapore to Malaysia,” which indicated a flight risk and justified the denial of bail.

The prosecution further argued that Mahanta allegedly supplied the liquor consumed by Zubeen Garg, after which the singer became “extremely drowsy” and was left in a vulnerable condition. Despite being aware of his medical history, including epilepsy, the accused allowed him to enter the water, which was reportedly unsafe under the circumstances.

Significantly, the court also approved the attachment of assets linked to the prime accused, Siddhartha Sharma. The Court ordered attachment of Siddhartha’s partnership in Mahavir Aqua, claiming the investment was made using funds allegedly misappropriated from Zubeen Garg.

In addition, the prosecution had sought attachment of multiple bank accounts of Sharma, allegedly containing “ill-got money” connected to the case. According to Kamar, six bank accounts were attached by the court, adding that the accused failed to produce documents proving the legitimacy of the funds. Certain accounts belong to his younger brother, to his mother, who had no separate source of income

Meanwhile, the case continues to progress rapidly. The next hearing is scheduled for May 2, when the key accused will submit written arguments before the court proceeds to the next stage.
