The food regulator flagged promotional claims in two products and found another follow-up formula non-compliant with prescribed Biotin levels
New Delhi: The Food Safety and Standards Authority of India (FSSAI) has initiated legal proceedings against Nestle India Ltd over alleged violations of food safety regulations involving three infant nutrition products.
The regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula, along with promotional material listed on e-commerce platforms.
FSSAI flagged claims related to “5HMOs” and “Whey Protein” in NAN Excella Pro Stage 1, while Lactogen Pro 1 carried a claim describing whey protein as easy to digest. The regulator said it sought clarifications from Nestle India over the claims.
According to FSSAI, both products contravened Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, and provisions of the 1992 law regulating infant milk substitutes and infant foods.
Separately, laboratory testing found a follow-up formula manufactured by Nestle India to be sub-standard for Biotin content. A referral laboratory also found the sample non-conforming with the prescribed requirement.
FSSAI said it has filed three separate adjudication cases against Nestle India in connection with the products. Following the development, Nestle India shares were down nearly 2 per cent at Rs 1,345.45 on the BSE at 1.10 pm.
