Supreme Court Empowers Assam to Clear Forest Encroachments with 15-Day Eviction Rule

A committee-led process will determine land classification and ensure lawful, time-bound action against illegal occupation while maintaining transparency and due process.

Guwahati: The Assam government has introduced a structured and legally backed mechanism to address encroachments on forest land, following Supreme Court directives that empower the state to take firm and timely action to protect its forests. It was announced by the Chief Minister, Himanta Biswa Sarma, during a media briefing on Wednesday.

Under the new framework, a designated committee comprising the District Commissioner and officials from the forest and revenue departments will first determine whether a disputed area qualifies as forest or revenue land. This classification will form the basis for further action.

Once land is confirmed as forest land, the authorities will issue eviction notices to alleged encroachers, giving them an opportunity to present their claims or objections. The committee will examine all submissions and pass a reasoned or ‘speaking order’ explaining its decision to ensure clarity and fairness.

If the land is upheld as forest territory, eviction proceedings can begin within 15 days of the order, enabling swift and decisive enforcement.

Officials said the move replaces earlier ad hoc eviction drives that often depended on individual initiatives. Instead, the new system establishes a uniform, transparent and time-bound process across the state, reducing ambiguity and ensuring legal compliance.

The government believes the policy will strengthen forest conservation efforts while safeguarding procedural fairness, striking a balance between environmental protection and the rights of individuals.
