AAP chief questions impartiality citing judge’s event participation; court reserves order after sharp exchanges

New Delhi: Arvind Kejriwal on April 13 urged the Delhi High Court to reassign a case linked to the 2021–22 excise policy, citing concerns over judicial neutrality.
Appearing in person, Kejriwal requested Justice Swarna Kanta Sharma to step aside from hearing a Central Bureau of Investigation appeal challenging his discharge. He pointed to her participation in events organised by the Akhil Bharatiya Adhivakta Parishad across multiple years, arguing this created a “reasonable apprehension of bias.”
“Even the perception of impartiality is crucial. A litigant must feel assured of fairness,” Kejriwal submitted, adding that ideological proximity could influence confidence in proceedings.
He also raised concerns over what he described as “selective urgency” in politically sensitive cases and alleged that investigative agencies had acted with bias.
Responding sharply, Tushar Mehta termed the plea “motivated theatrics,” cautioning that such arguments could undermine judicial functioning. Justice Sharma questioned the basis of linking event participation with prejudice.
The matter arises from a trial court order that had discharged Kejriwal, which the CBI has challenged. After extended arguments, the court reserved its order on the recusal request, keeping the larger proceedings pending.
